Use of products and services

This Terms of Use Agreement ("Agreement") governs your access to and use of NailFit Pro: Artistic Measure and other associated services, including mobile applications offered by Pamper N Style Essential Beauty, LLC. By registering for an account, accessing, or using the services, you agree to be bound by the terms of this Agreement. Please review this Agreement carefully. If you do not agree to these terms or cannot comply with them, do not use the services.

By accepting this agreement, you confirm that you are at least 16 years old, possess the necessary authority and capacity to enter into such agreements, and have read, understood, and agreed to the terms of this agreement before using the services. If you do not have the legal authority or capacity to enter into this agreement, you must obtain consent from your parents or legal guardian before using the services and agreeing to these terms. Your use of the services signifies that you have obtained such consent. If you lack the authority or capacity to enter into this agreement, do not use the services unless a parent or legal guardian agrees on your behalf.

Ownership

You acknowledge and agree that the NailFit Pro: Artistic Measure Services and any related software ("Software") used in conjunction with our Services are the proprietary and confidential property of our company, protected under intellectual property and other relevant laws. You also acknowledge that any content provided through our Services or by advertisers, including content in advertisements, is protected by copyright, trademark, patent, or other proprietary rights and laws. As such, unless explicitly permitted by law or authorized by our company or the applicable rights holder, you agree not to alter, modify, rent, lease, lend, sell, distribute, transmit, broadcast, perform publicly, or create derivative works based in whole or part on the NailFit Pro: Artistic Measure Services.

Monetization/Limited Liability

NailFit Pro: Artistic Measure operates as a commercial transaction application that includes in-app subscriptions. By purchasing a subscription, you gain full access to all features of the application for the duration of your paid period. Unpaid subscriptions will result in cancellation, and access to the features of NailFit Pro: Artistic Measure will be lost. Your use of the Services is at your own risk. The service is provided "as is" and without any warranties. NailFit Pro: Artistic Measure does not guarantee that the service will be uninterrupted or error-free and disclaims all liability for any errors or omissions in the information, software, or documents provided or linked through the service. Additionally, any references or links to third-party websites are provided "as is" and without any warranty, either express or implied.

User Behavior

NailFit Pro: Artistic Measure app offers a seamless way to measure and share your nail dimensions and operates on a subscription basis. To maintain uninterrupted service, please ensure your subscription payments are made on time. You have the option to cancel your subscription at any moment using the in-app delete account feature. Please refrain from using NailFit Pro: Artistic Measure to verbally abuse or harass other users. Additionally, sharing your login credentials or attempting to resell your subscription is prohibited; anyone desiring access to NailFit Pro: Artistic Measure must register and create their own account. NailFit Pro: Artistic Measure is accessible globally and is designed to cater to nail technicians and nail clients all around the world.

NailFit Pro Subscription Policy

Thank you for choosing NailFit Pro: Artistic Measure. Please review our subscription terms and conditions to understand how our service works.

Free Trial Period

• NailFit Pro offers a 7-day free trial period for new users. During this trial, you will have full access to the nail measurement tool.
• If you do not cancel your subscription before the end of the free trial period, you will be automatically charged for the selected subscription plan.

Subscription Plans

• 3 Months: $89
• 6 Months: $159
• 1 Year: $279.99

Automatic Renewal

• All subscriptions automatically renew at the end of the current subscription period unless auto-renew is turned off at least 24 hours before the renewal date.
• Your account will be charged for renewal within 24 hours before the end of the current subscription period, and the renewal cost will be clearly identified at that time.

Managing Subscriptions

• Subscriptions can be managed by the user. Auto-renewal can be turned off by navigating to your Account Settings after completing the purchase.
• Any unused portion of the free trial period, if offered, will be forfeited when the user purchases a subscription.

Cancellation and Refunds

• You can cancel your subscription at any time through your account settings. Please note that canceling your subscription will not refund the current active period; you will continue to have access to NailFit Pro for the duration of the paid subscription.

Measurement Tools

NailFit Pro: Artistic Measure delivers precise measurements in millimeters, using a standard nail sizing guide to categorize nail sizes as small, medium, or large. Please note that these standard sizes may not match your specific measurements. To ensure an accurate custom fit, base your nail size selection on the measurements provided by NailFit Pro: Artistic Measure.

• 1 = 16mm
• 2 = 15mm
• 3 = 14mm
• 4 = 13mm
• 5 = 12mm
• 6 = 11mm
• 7 = 10mm
• 8 = 9mm
• 9 = 8mm
• 10 = 7mm
• 11 = 6mm

Legal Concerns

NailFit Pro: Artistic Measure advises all nail technicians and users to adhere to industry-specific health and safety guidelines relevant to their region. NailFit Pro: Artistic Measure is not responsible for any damage or unsatisfactory results from services provided by nail technicians. We do not employ nail technicians and are a separate entity; therefore, we are not liable for any disputes or disagreements that may arise between you and your nail technician. NailFit Pro: Artistic Measure is solely responsible for the functionality and features of the NailFit Pro: Artistic Measure application.

Dispute Resolution

1. Scope of Dispute Resolution Terms - These terms apply to any disputes that may arise in relation to the use of the NailFit Pro: Artistic Measure application. By using this app, you agree to these terms.
2. Resolution Methods - In the event of a dispute, we provide the following methods for resolution, which you may choose from based on convenience and preference:
   • Arbitration: A neutral arbitrator will handle the dispute. The arbitration process is less formal than a court trial and is subject to very limited review by courts.
   • Mediation: A neutral mediator will attempt to facilitate a resolution between the parties. This method is non-binding and aims to reach an amicable settlement.
   • Litigation: Traditional court proceedings. You may file a lawsuit in a court of competent jurisdiction according to the local laws applicable to the Terms of Service.
3. Initiation of Dispute Resolution - To initiate a dispute resolution process, you must first contact our customer service department with your issue. If the issue is not resolved informally, you may choose any of the above methods for resolving your dispute.
4. Costs of Dispute Resolution - Each party will bear their own costs in the case of arbitration and mediation. In the event of litigation, the prevailing party may be entitled to recover reasonable attorneys' fees and costs as determined by the court.
5. Conditions for Arbitration
   • Procedure: Arbitration shall be initiated through an established alternative dispute resolution (ADR) provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules:
     • the arbitration shall be conducted by telephone, online, or based solely on written submissions (the specific manner to be chosen by the party initiating the arbitration);
     • the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and
     • any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
6. Binding Decision
   • Arbitration and Litigation: Decisions are binding and can be entered as a judgment in any court of competent jurisdiction.
   • Mediation: If the mediation results in an agreement, it can be made binding through a written agreement signed by both parties.
7. Waiver of Class Action - Users agree that any disputes will be handled on an individual basis, and that any claims brought must be on behalf of an individual, not as a plaintiff or class member in any class or representative action.
8. Opt-Out of Agreement to Arbitrate - You have the option to opt-out of the agreement to arbitrate by contacting us within 30 days of first accepting these terms and stating that you (include your first and last name) decline this arbitration agreement.
9. Jurisdiction and Venue - In case of litigation, the jurisdiction and venue shall be chosen based on the address provided by you in your account information, unless otherwise agreed.

Changes to These Terms

We may update these terms occasionally and will inform you of any changes in a suitable manner. By continuing to use the service after these updates, you are agreeing to the revised terms of service. These terms are effective starting 2024-09-01.
